Moving to Spain creates a long list of decisions. Your tax application should be planned alongside your employment arrangements and relocation dates. The Beckham Law application is made through Modelo 149, but completing the form is only one part of the process: the evidence supporting your move matters too.
This guide focuses on preparing and filing the application. For the wider tax rules and a comparison with ordinary taxation, see our Beckham Law advice in Spain.
Before you apply for the Beckham Law
Check your route into the regime
Start by identifying why you are moving and how you will work. A Spanish employment contract, an employer-ordered assignment and international remote employment can require different evidence. Other categories have their own conditions. A residence permit or a NIE does not, by itself, establish your entitlement to the tax regime.
Review eligibility and whether the regime suits you
Eligibility and suitability are separate questions. Review your previous tax residence, the circumstances of your move and the nature of your work. Then consider your income, family and assets before deciding whether to opt in. Our Beckham Law service page explains the broader eligibility and tax considerations.
What is the Beckham Law application deadline?
Identify the date that starts the six-month period
The general maximum period for the main applicant is six months from the activity start date recorded in the Spanish Social Security registration, the documentation allowing continued home-country Social Security coverage or, where registration is not compulsory, the document evidencing the activity start date. Do not assume the clock starts when you obtain your NIE or decide to submit the form.
Check assignments with an A1 or equivalent document
If you remain covered by your home system, bring the relevant coverage documentation to your adviser. The absence of a Spanish Social Security registration does not mean you can postpone reviewing your deadline. Family members have separate filing rules and should be assessed individually.
Which documents do you need for Modelo 149?
The exact file depends on the category under which you apply. Treat the following as preparation for a review, rather than a universal list that proves eligibility.
Tax identification and census registration
The AEAT requires a NIF and registration in its taxpayer census before the option is filed. If registration is missing, it must be dealt with first. Have your identification and existing tax-registration details ready so that inconsistencies can be identified early.
Employment, assignment and activity-start evidence
Prepare your employment or assignment documents and the relevant Social Security or activity-start evidence. The supporting employer statement and other records should explain the reason for the move and the dates applicable to your situation. Different routes require different evidence; a remote employee should not simply copy a checklist intended for someone hired locally.
Your relocation history and personal circumstances
For the initial assessment, prepare a timeline of where you have lived and worked, your intended or actual move, your employment arrangements and whether family members are relocating. Your adviser can then identify which supporting records are relevant and which need clarification before filing.
How to submit a Beckham Law application
Prepare and submit the supporting documentation
The AEAT provides a specific online procedure for the documents accompanying the option. This precedes Modelo 149. Its registration number must be included in the corresponding option form. Keep the submission receipts together so the form and its supporting material can be traced.
File Modelo 149 electronically
Once the preparatory steps are complete, the option is filed electronically. Each applicant files individually; the main applicant’s option precedes those of associated family members. If a professional acts for you, agree how representation will be arranged and who will monitor communications.
Keep the receipt and follow up on communications
Store the filed form and supporting-document receipts. A submission receipt confirms filing; it should not be treated as a guarantee that every substantive condition is satisfied. Clarify who will deal with requests for further information and what ongoing assistance is included.
Plan for the annual Modelo 151
Modelo 149 is the option communication. Taxpayers under the special regime use Modelo 151 for the annual return. Discuss ongoing obligations when arranging the application, so that responsibility for the following tax year is clear.
Common Beckham Law application mistakes
- Using the wrong starting date. Check the official activity and coverage records instead of relying on the date you remember arriving.
- Assuming all applicants need the same documents. The evidence must match the actual reason for your move.
- Confusing a visa with a tax election. Immigration status and the tax regime require separate analysis.
- Waiting until everything else is finished. Review the deadline while planning the relocation, not at the end.
- Stopping at the filing receipt. Agree how follow-up communications and annual returns will be handled.
How MOBA LAW can help with your application
Our work starts with your circumstances: whether you are moving to Spain for a new role, arriving on an assignment or working remotely. We assess eligibility and suitability, identify the documentation relevant to your route and help prepare and file the option. We can also assist with the annual return and the tax implications of changes in your circumstances.
What to tell us when requesting a quote
In your first message, give us your planned or actual move date, where you have been tax-resident, your employment arrangements and any known activity-start date. Let us know if you are relocating with family. A short summary is enough to start the conversation; we can agree the scope and documentation needed for the review.
