Tax residence comes first

Before discussing taxes, you need to know where you are resident. In Spain you are if you spend more than 183 days in the calendar year or your main centre of activities or economic interests is here. It is presumed if your spouse and dependent minor children live in Spain.

If another country also treats you as resident, the tax treaty settles the conflict. A tax residence certificate from that country is usually the key evidence.

Worldwide income and double taxation

As a Spanish resident you are taxed on everything you earn, here and abroad. To avoid paying twice, the law allows a credit for foreign tax paid, within limits, and treaties allocate which country may tax each item.

That is why tax should be reviewed before a move, an investment abroad or selling an asset in another country.

Modelo 720

Residents must report assets and rights held abroad: accounts, securities and property. For accounts there is no obligation if combined balances do not exceed €50,000. It is filed between 1 January and 31 March, and in later years only if balances rise by more than €20,000.

Your first year of Spanish residence is when it is most often forgotten. We review it together with your first return.

Wealth tax

Residents are taxed on worldwide wealth and non-residents only on assets in Spain. Unless the region sets another amount, the state allowance is €700,000, and the main home is exempt up to €300,000.

Each region can set its own allowances and reliefs, so the outcome depends on where you live.

Companies: corporate tax and VAT

The standard corporate tax rate is 25%, with reduced rates for small and newly created companies that meet the legal requirements. VAT, withholding and instalment payments come on top.

A clear tax calendar and up-to-date accounts are the best defence in any tax review.

COMMON MISTAKES

What costs the most
later on.

Believing 183 days away is enough

Your centre of interests and family also count for residence.

Forgetting Modelo 720 on arrival

Your first resident year is when foreign assets are most often left unreported.

Declaring only Spanish income

As a resident you are taxed on worldwide income, not only what you earn here.

Deciding before calculating

Selling, gifting or moving country without planning is usually expensive.
